Total Amount : Euro 130,000,000/- Lease rate : You quote Renewal Rate : You quote First Tranche : Euro 30,000,000/- Subseq. Tranches : Euro 100,000,000/- Proof of Funds : Currently Dated, Signed Tear Sheet, Bank Statement, BCL Payment : ICBPO Delivery : Electronic immediately, with originals in 7 days as per instructions PROCEDURES FOR FIRST TRANCHE OF EURO 30 MLN AND SUBSEQUENT TRANCHES: 1. Provider (First Party) submits FCO, after the acceptance of the terms of the FCO in writing by the Leasee Party (Second party) , the two parties will exchange the following: (a) Color passport copy, (b) Board resolution to undertake transaction, (c) Affidavit - money laundering indemnity, (d) Company registration certificate, (e) Client Information Sheet. The copies of these instruments are to be transmitted by email/facsimile are legally binding and enforceable. 2. The agreement duly signed and sealed is lodged in banks of the corresponding Parties. Bank Officers can communicate upon this agreement. 3. Within Five (5) banking days upon signing the present contract delivering of all documents as stated above the designated Bank of the First Party issues a Pre-Advice via swift MT-799 to a Second Party's bank about readiness to issue bank guarantee in favour of Second Party. 4. After Bank to Bank Verification and Authentication of the Bank Guarantee, the Bank of the Second Party will within Five (5) banking days upon receipt of the Pre-Advice issue a transferable Irrevocable Conditional Bank Payment Order (ICBPO) via Swift MT 799 to a First Party's designated bank for the amount of X% of the Bank Guarantee face value which will be Euro Thirty Million and this Swift MT 799s is valid until First Party performs in full its obligation under the present contract. 5. Issuing Bank will then send the Bank Guarantee to the Bank of the Second Party via Swift MT 760 within Five (5) banking days of receipt of the ICBPO of (X%) via swift MT 799 from the Second Party to the Bank of the First Party. 6. Upon verification, authentication and receipt of the bank guarantee by the designated Bank of the Second Party, Second Party’s Bank will pay the ICBPO MT 799 to the First Party's s Bank account within three (3) banking days. 7. Issuing Bank will send to the Second Party's bank the original of Bank Guarantee by bonded courier to Second Party’s bank once the above ICBPOs MT 799 of X% is paid out to First Party. We repeat the process for the balance amount.
